Privacy Policy and Terms of Service

1. Scope

This Privacy Policy describes how Rubix Technology LLC collects, uses, discloses, and protects information in connection with our public websites (the “Websites”). Separate agreements may apply to software, appliances, hosted applications, licensing portals, and other products or services you purchase or deploy (collectively, “Products”). Processing of data within Products is governed by the applicable product documentation, license, order form, and any business associate agreement or other written contract in place.

Website contact and interest forms are intended for business inquiries only. They are not intended for the submission of protected health information (PHI), patient records, or payment card numbers.

2. Information We Collect

Information you provide. When you submit a form or otherwise contact us through a Website, we may collect your name, business email address, telephone number, company name, job title, and the content of your message.

Information collected automatically. When you visit a Website, we and our service providers may automatically collect technical information such as IP address, approximate location derived from IP address, browser type, device type, referring URL, pages viewed, and timestamps.

Cookies and similar technologies. We use cookies and similar technologies for website operation, security (including bot protection), and analytics. You may control cookies through your browser settings. Disabling certain cookies may affect website functionality.

3. How We Use Information

We use information collected through the Websites to respond to inquiries; operate, secure, and improve the Websites; understand aggregate usage; prevent fraud and abuse; and comply with applicable law.

We do not sell personal information collected through the Websites as a consumer data product.

4. Sharing of Information

We may share Website information with service providers who assist us with hosting, email, analytics, security, content delivery, or customer relationship management, subject to appropriate confidentiality and use restrictions; with our personnel as needed to respond to your request; with professional advisors; with authorities when required by law or to protect rights and safety; and with a successor in connection with a merger, acquisition, or sale of assets.

5. Retention

We retain Website form submissions and related records for as long as reasonably necessary for business follow-up, security, dispute resolution, and legal obligations, and then delete or de-identify them when no longer needed. Analytics retention follows the settings of our analytics providers.

6. Security

We maintain administrative, technical, and organizational measures designed to protect Website information. No method of transmission or storage is completely secure.

7. International Visitors

Rubix Technology LLC is located in the United States. If you access the Websites from outside the United States, you understand that information may be processed in the United States.

8. Your Choices and Rights

Depending on applicable law, you may have rights to access, correct, delete, or restrict certain personal information, or to object to certain processing. To submit a request regarding Website data, email sales@rubixtechnology.com with “Privacy Request” in the subject line. We may need to verify your identity. You may unsubscribe from marketing emails using the link in those messages; transactional messages may continue.

9. Children

The Websites are intended for business users. We do not knowingly collect personal information from children under 16 through the Websites.

10. Third-Party Links

The Websites may contain links to third-party websites. Their privacy practices are governed by their own policies.

11. HIPAA-Related Practices

Rubix designs certain products and services with HIPAA safeguards in mind (such as access controls, encryption where applicable, and auditability). That design approach is not a representation that Rubix or any Product is “HIPAA certified” or that any particular deployment satisfies a covered entity’s or business associate’s obligations under HIPAA.

Where Rubix acts as a business associate under HIPAA, we enter into a Business Associate Agreement when applicable. Requests may be directed to sales@rubixtechnology.com.

Do not submit PHI or other sensitive health information through Website forms. PHI processed in Products is handled in those Products under the customer’s configuration and applicable contracts.

12. Payment Card Practices

Paid purchases, where offered, are processed through payment processors that maintain PCI DSS compliance programs. The Websites are not intended to collect or store full payment card numbers. Do not enter full card numbers into Website contact forms. Cardholder data for transactions is handled by the payment processor according to its responsibilities.

Certain Products may assist customers with defensive vulnerability assessment activities related to PCI DSS. Such Products are not an official Approved Scanning Vendor (ASV) attestation and are not a penetration test. Use of such Products does not by itself mean an organization is “PCI certified.”

13. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The “Last Updated” date will change when we do. Continued use of the Websites after an update constitutes acceptance of the revised Privacy Policy.

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Websites. Additional terms may apply to Products, licenses, subscriptions, and support. If a signed written agreement conflicts with these Terms on a given subject, that agreement controls for that subject.

By using the Websites, you agree to these Terms.

2. Informal Nature of Website Content

Website content is provided for general informational and evaluation purposes. It does not constitute a binding offer for every feature, configuration, or price. Commercial terms are set forth in applicable order forms, licenses, and related agreements.

3. Acceptable Use

You agree not to misuse the Websites, including by attempting unauthorized access, interfering with security or availability, submitting malicious code, or using forms for harassment or unlawful purposes. Do not submit PHI or full payment card numbers through Website forms.

4. Intellectual Property

The Websites and their content are owned by Rubix or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, or distribute Website content except as expressly permitted in writing.

5. Disclaimer of Warranties

THE WEBSITES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUBIX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RUBIX DOES NOT WARRANT THAT THE WEBSITES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

6. Customer Responsibility; Misuse

Our Products are tools. You are solely responsible for configuring, deploying, operating, monitoring, and securing Products in accordance with applicable law, your policies, and sound security and operational practices, including access control, patching, backups, key management, network design, monitoring, and determining what data you process.

Rubix Technology LLC is not liable for misuse of its Products or services by customers, end users, or third parties, including without limitation: unlawful use; use that circumvents or disables security controls; unauthorized access or attacks by third parties involving systems you operate; and harm arising from configurations, policies, integrations, or data you choose to run.

Where Products are deployed on infrastructure you control, or where you control keys or data paths, you control the operating environment. Rubix does not assume responsibility for all possible configurations or for decisions made by operators of that environment.

Documentation and marketing materials describe capabilities; they are not a guarantee against misuse or against every failure mode.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUBIX TECHNOLOGY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITES OR ARISING FROM MISUSE, UNAUTHORIZED USE, FAILURE TO FOLLOW DOCUMENTATION OR SECURITY BEST PRACTICES, OR THE ACTS OR OMISSIONS OF CUSTOMERS, END USERS, OR THIRD PARTIES.

Nothing in these Terms limits liability that cannot be limited under applicable law, or rights you have under a signed written agreement that expressly provides otherwise.

8. Indemnification

To the extent permitted by law, you agree to defend and indemnify Rubix Technology LLC from and against claims arising out of your misuse of the Websites or your violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles, unless a signed agreement provides otherwise.

10. Changes to Terms

We may update these Terms from time to time. The “Last Updated” date will change when we do. Continued use of the Websites after an update constitutes acceptance of the revised Terms.
